Hostaway Affiliate Program Terms and Conditions

These Terms and Conditions (“Terms”) govern your participation in the Hostaway Affiliate Program (the “Program”). By participating in the Program, you agree to be bound by these Terms, Hostaway’s Terms of Service, and Privacy Policy.
Introduction
The Program is made available to you by Hostaway, wholly subject to these Affiliate Terms, the Hostaway Terms of Service, and the Hostaway Privacy Policy.
In the event of any conflict between the Affiliate Terms and the Hostaway Terms of Service, the Affiliate Terms shall prevail solely in relation to the Program.
Definitions
Program: The Hostaway Affiliate Program governed by these Affiliate Terms.
Affiliate: An individual or entity approved by Hostaway to refer new customers using a Unique Affiliate Link, and eligible to earn Commissions under the Program.
Referred Customer or Referral: A new customer who signs up for Hostaway through the Affiliate’s Unique Affiliate Link, satisfies all eligibility criteria, and enters into a valid subscription agreement with Hostaway.
Existing or Returning Hostaway Customer: A person or entity who currently has, or previously had, an active Hostaway account or subscription.
Qualified Referral: A referral that results in a Referred Customer signing up via the Affiliate’s link, paying all required fees, and remaining in good standing.
Commission: The 20% Net Revenue share payable to Affiliates for the first year of a Referred Customer’s subscription.
Net Revenue: Revenue actually received by Hostaway from a Referred Customer, excluding any amounts attributable to add-ons, setup or onboarding fees, taxes, refunds, chargebacks, payment processing fees, credits, and discounts.
Unique Affiliate Link: The personalized tracking link provided to the Affiliate to identify and credit Referrals under the Program.
Fraudulent Activity: Any attempt to manipulate, abuse, or falsify referrals, including self-referrals, fake accounts, tampering with tracking, or misrepresentation.
Program Materials: Marketing materials, brand assets, banners, or other content provided by Hostaway to Affiliates for use in promoting Hostaway.
Affiliate Program Details
For the Affiliate
Earn a 20% Commission on Hostaway's Net Revenue from each Qualified Referral.
Commission applies only to the first twelve (12) months of the Referred Customer’s subscription.
Commissions are paid monthly via Hostaway’s designated affiliate management platform.
No Commission is paid beyond the first twelve (12) months.
For the Referred Customer
Must be new to Hostaway (not an existing or returning customer).
Must sign up via the Affiliate’s Unique Affiliate Link.
Must enter into a valid subscription agreement and pay all required fees.
Eligibility and Exclusions
The Referred Customer must be a new Hostaway customer and enter into a valid subscription agreement with Hostaway.

Existing or Returning Hostaway customers are not eligible as Referred Customers.
Hostaway employees are not eligible to participate as Referrers or Referred Customers.
Only one Commission per Referral will be issued.
The Program cannot be combined with any other offers, discounts, or promotions, nor applied retroactively.
Referrals must be made using the Affiliate’s Unique Affiliate Link — manual attribution or crediting is not permitted.
Commission Payments
Commissions are calculated on Net Revenue (exclusive of taxes, refunds, chargebacks, fees and adjustments) actually received by Hostaway.
Commissions will be paid monthly in arrears, for up to twelve (12) months, commencing from the month Hostaway first receives revenue from the Referral
Commissions are subject to manual review and approval by Hostaway.
Clawbacks: If a Referred Customer downgrades, cancels, fails to pay, or receives a refund, Hostaway reserves the right to withhold, reverse, reduce or deduct any related Commission. Hostaway may offset clawbacks against future Commissions.
Non-transferability of Commissions
Commissions are non-transferable and may not be assigned, bartered, or sold.
Any attempt to transfer Commissions will result in forfeiture of any Commissions owing and disqualification from the Program.
Limitations on Liability
Hostaway’s total aggregate liability under these Affiliate Terms will not exceed the total Commissions actually paid to the Affiliate in the twelve (12) months preceding the event giving rise to the claim.
Hostaway is not liable for indirect, incidental, or consequential damages, including lost profits or business opportunities.
Hostaway does not guarantee any level of success or income as a result of participation in the Program.
Hostaway is not responsible for any taxes, fees, payments or other costs associated with the receipt of Commissions. All such obligations are the sole responsibility of the Affiliate.
The Affiliate agrees to indemnify, defend, and hold harmless Hostaway, its officers, directors, and employees from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to the Affiliate’s breach of these Terms, violation of law, or misuse of the Program.
Referral Tracking and Verification
Referrals must be made through the Affiliate’s Unique Affiliate Link.
Referred Customers must become paying Hostaway Customers within 90 days of clicking the Unique Affiliate Link for Affiliates to qualify for a Referral reward. Referrals that occur after the 90-day window will not qualify for a reward.
Customers who disable cookies, clear cookies after clicking the link, or sign up from a different browser, device, or computer than the one used to click the Unique Referral Link may not be tracked correctly and will therefore not qualify as a Referred Customer.
Hostaway reserves the right to verify the eligibility of any participant and the validity of any Referral.
Hostaway may request additional documentation or proof to verify eligibility and compliance.
Fraud Prevention
Hostaway reserves the right to monitor all Program activity and withhold or deny Commissions in cases of suspected fraud, abuse, suspicious behavior, or any violation of these Terms. Hostaway’s determination shall be final and binding
Any attempt to manipulate or abuse the Program, including but not limited to self-referrals, creating fake accounts, or providing false information, will result in immediate disqualification from the Program and forfeiture of any unpaid Commissions.
Hostaway’s decision regarding fraud prevention and disqualification is final and binding.
Program Communications
Participants may receive automated or manual email communications related to program updates, Referral status, reward eligibility, and account access details (such as portal login credentials).
By joining the Program, participants agree to receive both operational and marketing communications from Hostaway related to the Affiliate Program.
It is the participant’s responsibility to ensure their contact information is accurate and up to date to receive such communications. Unsubscribing from communications may limit ability to receive payments or updates
Promotional Conduct and Brand Use
Affiliates must comply with Hostaway’s promotional and brand guidelines. In particular, Affiliates may not:
Bid on or use “Hostaway” or similar variations (e.g., “HostAway”, “Host away”, “Hostaway PMS”) in paid search or social-media advertising or domain names;
Share promo codes on coupon or discount directories or distribute them through third parties without Hostaway’s written consent;
Misrepresent their relationship with Hostaway or suggest official partnership status; or
Claim referrals for customers already engaged with Hostaway.
Affiliates may use Hostaway’s trademarks and marketing materials solely as provided and only for the purpose of promoting Hostaway under this Program. All rights not expressly granted are reserved by Hostaway. Affiliates must cease all use of Hostaway’s IP upon termination of participation in the Program.
Violations will result in disqualification from the Program and forfeiture of unpaid Commissions.
Campaigns and Special Events
From time to time, Hostaway may, at its sole discretion, offer Affiliates the opportunity to participate in promotional campaigns, incentive programs, contests, or other special offers (each, a “Special Promotion”).
Participation in any Special Promotion is subject to these Terms, together with any additional terms, conditions, or eligibility requirements communicated by Hostaway in connection with the specific promotion. Hostaway reserves the right to determine eligibility, participation criteria, and applicable rewards, and may modify, suspend, or terminate any Special Promotion at any time without prior notice.
Governing Law and Dispute Resolution
These Referral Terms are governed by and construed in accordance with the laws of Finland.
Any disputes arising out of or in connection with the Program shall be subject to the exclusive jurisdiction of the courts of Finland.
Program Changes and Termination
Hostaway reserves the right to modify, suspend, or terminate the Program or these Affiliate Terms at any time, for any reason, and without prior notice. In the event of termination, only approved Commissions earned prior to termination will be paid.
Any changes to the Program or these Affiliate Terms will be effective immediately upon posting on the Hostaway website or other official communication channels.
Continued participation in the Program after any changes constitutes acceptance of those changes.
General Terms
Hostaway reserves the right to disqualify any participant it deems to be in violation of these Referral Terms.
These Referral Terms represent the entire agreement between Hostaway and the participant concerning the Program and supersede any other promotional representations and communications.
The Program is subject to all applicable laws and regulations.
Any provisions of these Referral Terms which by their nature should survive termination shall survive termination, including but not limited to fraud prevention, limitation of liability, and governing law.
Privacy and Data Protection
Hostaway processes personal data of Affiliates in accordance with its Privacy Policy, which explains how such data is collected, used, and protected in connection with the Affiliate Program. By participating, you acknowledge that you have read and understood the Privacy Policy.

Affiliates must comply with all applicable data protection and privacy laws, including GDPR, when handling any personal data related to the Program. Affiliates are solely responsible for ensuring their marketing and data practices comply with all legal requirements.
